These Terms of Service ("Terms") govern your use of medtek.ki ("the Service"), operated by medtek.ki ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.
1. Service Description
medtek.ki is an AI-powered troubleshooting assistant for biomedical and medical equipment. The Service provides AI-generated suggestions, device identification from photos, and work order draft generation.
2. AI-Generated Content — Important Disclaimer
THE SERVICE USES ARTIFICIAL INTELLIGENCE TO GENERATE RESPONSES. AI CAN AND DOES MAKE MISTAKES. ALL AI-GENERATED CONTENT IS PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ACCURACY, COMPLETENESS, OR FITNESS FOR A PARTICULAR PURPOSE.
Specifically, you acknowledge and agree that:
- AI-generated troubleshooting suggestions, diagnostic information, and recommendations may be inaccurate, incomplete, or inappropriate for your specific situation.
- The Service does not replace professional training, manufacturer service manuals, or certified service technicians.
- You are solely responsible for evaluating and verifying all AI-generated content before acting on it.
- Device identification extracted from photos (serial numbers, model numbers, registration numbers) may contain errors. Always verify extracted information against the physical device.
- Work order drafts are generated based on conversation context and may contain inaccuracies. Review and correct all drafts before submitting to your CMMS or official systems.
- Regulatory guidance provided by the AI (standards references, safety limits, test procedures) is informational only and may not reflect the most current regulations. Always consult official regulatory sources.
3. Medical Device Safety
You acknowledge that medical devices directly or indirectly affect patient safety. You agree that:
- You will not rely solely on the Service for safety-critical decisions regarding life-support equipment, radiation therapy devices, or any device where incorrect repair could endanger patients.
- You will follow your organization's policies, manufacturer guidelines, and applicable regulations when servicing medical equipment.
- We are not liable for any injury, death, equipment damage, or regulatory non-compliance resulting from actions taken based on AI-generated content.
4. User Responsibilities
- You must be a qualified professional (biomedical technician, clinical engineer, or equivalent) or be supervised by one when using the Service for equipment troubleshooting.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must not upload images or information that contain patient-identifiable data (PHI/PII). The Service is for equipment troubleshooting, not patient data.
- You must comply with all applicable laws, regulations, and your employer's policies when using the Service.
5. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. Conversations, uploaded images, and work order drafts are stored in our systems to provide the Service. We do not sell your data to third parties.
6. Intellectual Property
You retain ownership of all content you upload (photos, text). We retain ownership of the Service, its design, code, and AI system prompts. AI-generated responses are provided for your use but do not constitute our professional advice or endorsement.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
- WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.
- OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED US DOLLARS (USD $100).
- WE ARE NOT LIABLE FOR DAMAGES ARISING FROM YOUR RELIANCE ON AI-GENERATED CONTENT, INCLUDING BUT NOT LIMITED TO EQUIPMENT DAMAGE, PERSONAL INJURY, REGULATORY FINES, OR BUSINESS LOSSES.
8. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or actions taken based on AI-generated content.
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses caused by service interruptions.
10. Termination
We may suspend or terminate your account if you violate these Terms or use the Service in a way that could harm other users or the Service itself. You may delete your account at any time by contacting us.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Continued use of the Service after changes constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of Norway, where medtek.ki is registered. Any disputes shall be resolved in the courts of Norway, unless mandatory consumer protection laws in your country of residence provide otherwise.
